Once again overweight people are in the firing line. Life insurance companies are raising premiums up to 400% for fat

people. They've always charged more for those who clearly over-eat, but during the last year or so the penalties have

got worse and more people are being affected.

In moves to tighten the belts, the life companies have lowered the limits they use to categorise peoples weight. This

means that those who are merely overweight and would have previously qualified for a standard premium, now are

punished with higher premiums – and the premiums rise quickly the more overweight the insurers believe you are.

How do they classify you weight? They use something called the Body Mass Index. The typical insurance company

considers a BMI of between 18.5 and 24.9 to be normal. Over 25 classifies you as overweight. Above 30 and they think

you're obese.

When you apply for life insurance, your weight and height are just two of the many questions you have to answer.

For example, a 35 year old, healthy non smoking man who asks for ?150,000 level life insurance cover over 25 years

will currently be quoted ?18.77 by Scottish Provident - but this could easily leap to ?35 if he's overweight and up to ?47

if he's obese.

And over the last 20 years weight has been a growing problem. Today, more than 50% of women and 60% of men

are judged as overweight. And looking at our children, the problem won't improve. In youngsters aged between 2 and

15, 28% of girls and 22% of boys were found to be overweight.

So if you have a BMI over 25 it's going to be especially important to get your life insurance with as big a discount as

possible. In our experience that means you'll have to shop on the Internet. Competition there is high and this has

forced web sites to give clients very significant discounts.

How Viatical Settlements Work

Viatical settlements are relatively common. Here’s how they work. The owner of the life insurance policy sells the

policy for a percentage of the death benefit. The discounted price received is typically 60 to 70 percent of the policy’s

face value.

The viatical settlement buyer becomes the new policy owner and/or beneficiary of the life insurance policy and is

responsible for paying all future premiums. The buyer also collects the death benefit of the policy when the insured

dies.
The original owner of the insurance policy, incidentally, may not necessarily be the individual with the life-threatening

illness.

The approval process for viatical agreements is generally based on the nature of the illness or condition and a doctor’s

review of the insured’s medical records. Usually the viatical settlement transaction is facilitated through a broker or a

trusted insurance agent—without the buyer ever meeting the ill person.

Guidelines for the Sale of Viatical Settlements

Almost any type of life insurance can be sold through a viatical settlement as long as the policy doesn’t prohibit

transferring ownership rights. Universal, whole, term, and even group life insurance policies are usually accepted.

However many policies include a “contestability clause” that allows an insurance company to cancel a policy if it

discovers that the policy holder had a preexisting condition. Therefore, most settlement companies will only buy

policies that are at least two years old.

There are generally two types of companies that purchase viatical settlements. The first type buys life insurance

policies directly from ill people, using either private funds or proceeds from the sale of company stock. These

companies, themselves, hold all the rights to the insurance policy and act as the designated beneficiary of the policy.

These are considered to be "non-brokered" transactions because the viatical settlement provider purchases the policies

directly.

The second type of viatical settlement company acts as a broker or intermediary—the category into which most

settlement companies fall. They match a group of potential buyers with a life insurance policy available for sale, rather

than directly purchasing the policy. As the broker, the viatical settlement company doesn’t own the policy. Instead, it is

entitled to a percentage of the death benefit or purchase price—usually 4 to 6 percent—as compensation for its

services.

Each settlement company has its own set of rules and limitations that govern the purchase of viaticals. The death

benefit percentage that individuals receive when selling their policies is largely determined by their life expectancy. The

shorter the life expectancy, the more they can expect to receive for their insurance benefits.

For example, an individual with just eight months to live may receive more than 90 percent of a policy’s face value.

Someone expected to live for two years, on the other hand, may only be able get 50 percent of the death benefit.

State Regulations

Regardless of how much the policy holder receives from the insurance policy, viatical settlement payments are

generally tax-free. However, to qualify for tax-favored treatment, the individual must be terminally ill and live in a state

that regulates viatical settlements. Residents of other states may receive a tax benefit if the company buying the policy

satisfies viatical settlement guidelines outlined by the National Association of Insurance Commissioners.

There are a variety of limitations involved with viaticals sales, depending on the state involved. Therefore, anyone

considering a viatical settlement should consult with a qualified tax and legal professionals.

As another piece of advice: Before finalizing a viatical settlement, policy holders should also explore options that their

life insurance firms may offer. Increasingly, companies allow policy holders to borrow against their policies. And some

policies offer a cash value separate from the death benefit and accelerated death benefits that can offer access to

cash. If no feasible options are available, viatical settlements may be the ideal option for terminally ill individuals and

insurance policies. Consequently, the life settlement industry has seen significant growth in recent years. A study by

Conning & Co. Research found that senior citizens owned approximately $500 billion worth of life insurance in 2003, of

which $100 billion was owned by seniors eligible for life settlements. Since 2003, more and more of these eligible

senior clients have sold their policies and helped the market increase.

Separate research by the University of Pennysylvania’s business school found that life settlement providers paid

approximately $340 million to consumers for their underperforming life insurance policies, an opportunity that was not

available to them just a few years before. "We estimate that life settlements, alone, generate surplus benefits in

excess of $240 million annually for life insurance policyholders who have exercised their option to sell their policies at a

competitive rate," according to the research.

Selling Your Policy

You could be a prime candidate if you are of retirement age, have paid off your mortgage and other debts, and no

longer require the financial protection of life insurance. The amount you receive will depend on your age, health, death

benefit, and the number of years your policy has been in force.

Seniors with the greatest chance of selling their policies are those that are older than 65 years of age, have a

calculated life expectancy of more than two years (but less than 10 years) and may have experienced a health change

type of policy can be sold, including universal life, whole life and convertible term contracts. However, policies

generally must be valued at least $100,000.

Determining whether to sell your life insurance policy is a purely personal decision. You might consider a life settlement

• You need additional funds to pay medical/long-term care expenses.

• Your insurance premiums are too expensive and you can no longer afford them.

An important concept in this regard is insurable interest. You must have what is known as an insurable interest in the

life of the person you are insuring. Believe it or not there was a practice in the nineteenth century whereby people

would take out speculative insurance policies on the life of another.

For example, if I knew you were going on a dangerous voyage, I might take out a life insurance policy on you in the

hope that you wouldn’t make it and I would get a big payout. These days you cannot insure anybody’s life. You must

show that you have an interest in that person being alive. You are presumed always to have an interest in the life of

your spouse and guardians, if you are a minor, but all other relationships will have to prove the insurable interest. If

employers have a very highly valued employee, or sports teams have a star player, or a famous actor contracts to

make a film, their employers will be able to insure their lives.

Most life insurance policies will have a suicide clause stating that if the insured commits suicide, usually within a period

of two years, the policy will not pay out. There is also a contest period. This will also be approximately two years and if

the insured dies within this period, the insurance company has greater rights to investigate the death before deciding

whether or not to pay out.

The value of the insurance policy will be subject to the principle of insurable interest also. For example, if your spouse

provides you with $10,000 per year in support, you probably will not be able to take a $50 million insurance policy on

their life. The premium will be calculated based on the amount to be paid out and the assessed risk of the insured’s

death.

RAC' web site. Click on “Car Buying” and then “Vehicle Status Checks”. The Status Check will cost you ?24.99 but it will

confirm whether the car has outstanding finance. Best to be safe – without this Check you could find out that a finance

company actually has a prior title to the car.


• Carefully examine the car in good daylight. Look carefully for signs of repairs and accident damage. If you have

followed our advice and obtained a Vehicle Status Check, that Check will also notify you if the car has previously been

“written off”.


• Try to ensure that the car hasn't been “clocked”. (Clocked means that the mileometer has been wound back to show

a lower mileage.) The average annual mileage is around 12,000. Be wary if the wear and tear on the car looks greater

than you would expect from the mileage. The wear on the driver's pedals is usually a give away. Then ask when the

tyres were last replaced. Does the wear on the tyres look about right?


• Insist on test-driving the car for at least 10/15 miles. You need to get the car fully warmed up and drive it in varying

conditions. Incidentally, don't forget to ensure you are insured to drive it! Don't assume that your own insurance policy

will cover you for driving someone else's car. Check your policy before you leave home. If the seller claims that his

insurance covers you, ask to see his policy – a bit of a pain but better safe than sorry!


• Has the car ticked all the boxes so far? Then spend some more money get it professionally inspected.


• Never pay any money until you have seen the results of the RAC Vehicle Status Check. And even then, avoid paying

any money until the car is handed over to you complete with its Documents and tax disc. Always get a written receipt

for any money you pay and ensure that it includes the sellers name and address.


• Last of all, make sure you're insured from the moment you drive the car away. The Police can now impound, and

ultimately scrap, your car if you're driving it without insurance or road tax! If the car has not got Road Tax disc, call in

at the Post Office on the way home and get one. You'll need to show them a valid insurance cover note for the car and

the cars up to date MOT Certificate.

If you've followed all these steps you'll have done just about everything possible to ensure the car is legally yours at
